Terms of service

Effective Date: September 12, 2026

Everlasting Storybooks is a brand of Print Nation, LLC, a Nevada limited liability company (“Everlasting Storybooks,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of everlastingstorybooks.com (the “Site”) and your purchase of personalized books and related services from us.

By using the Site or placing an order, you agree to these Terms, along with our Privacy Policy, Return, Refund & Remake Policy, and Shipping & Delivery Policy, which are part of these Terms. If you don't agree, please don't use the Site or place an order.

1. Who Can Use Our Service

You must be at least 18 years old and able to enter into a binding contract to place an order. Our Site and service are designed for parents, grandparents, and other adults ordering on behalf of a child. We do not knowingly collect information directly from children under 13, and children may not create accounts or place orders. When you submit a child's name, photos, or other details, you confirm that you are the child's parent or legal guardian, or have that person's permission to do so.

2. What We Make

Everlasting Storybooks creates personalized, printed children's books. You choose a story theme, provide your child's name, gender, and photos, and we create illustrated characters and a custom book around them. Each book is made to order for one child.

About our character artwork. We use artificial intelligence, with review and refinement by our team, to transform your child's photos into a character rendered in the art style you select — which may range from illustrated to realistic, depending on the theme and options you choose. Features such as hair, skin tone, eye color, and facial details are generated from your photos and approximated to fit the chosen style; results vary with photo quality, lighting, angle, and expression. You will see exactly how your child's character appears in your character proof before anything is printed, and you can request changes or work with a designer before you approve.

3. Ordering, Pricing, and Payment

Prices are listed in U.S. dollars and may change at any time without notice. The price in effect when you complete checkout applies to your order. Applicable sales tax and shipping are calculated at checkout.

Payment is due in full at checkout. We accept the payment methods shown on the Site. By providing a payment method, you confirm you are authorized to use it.

Order acceptance. Your order is an offer to purchase. We may decline or cancel any order — for example, for suspected fraud, pricing or listing errors, content we can't or won't print (see Section 6), or if we are unable to produce your book. If we cancel an order you've already paid for, we'll refund you in full.

Promotions and gift cards. Discount codes and gift cards are subject to the terms stated when issued, cannot be exchanged for cash except where required by law, and cannot be combined unless we say otherwise. Gift cards do not expire.

4. How the Process Works

Your book is approved in two stages: first the character, then the full book.

  1. Order. Choose a theme, enter your child's details, and upload photos. Follow our photo guidelines — clear, well-lit, front-facing photos produce the best results.
  2. Character proof. We transform your child's photos into an illustrated character and show it to you, typically within [24 hours] of receiving usable photos. If your photos are unusable, we'll ask for replacements, and the clock restarts when we receive them.
  3. Approve your character. This is the stage to get the likeness right — hair, skin tone, eyes, glasses, expression. You may request revisions to the character or work with a designer (see Section 5) until you're happy. Approving the character locks in how your child will appear throughout the book.
  4. Book proof. Using your approved character, we create the complete book — every page, with your child's name and details — and notify you when it's ready to review.
  5. Approve your book. Review every page carefully — name spelling, gender, text, and layout. Corrections to those details are free at this stage. Requests to change the character's appearance after you've approved it require the book to be regenerated and are handled in a 30-minute one-on-one designer session for $15. When you're satisfied, you approve the book. Your book approval is final. It confirms the book is exactly as you want it and authorizes us to print it.
  6. Production and shipping. Production begins on the next business day after book approval. Production and transit times are described in our Shipping & Delivery Policy.

You are responsible for reviewing your proofs. We are not responsible for any error, omission, or dissatisfaction that was visible in a proof you approved, including misspellings, wrong details, or how closely the illustration resembles your child. See our Return, Refund & Remake Policy for what happens before and after approval.

Unapproved proofs. If your book proof remains unapproved 60 days after your order, we will cancel the order and refund you.

5. Designer Sessions and Rush Service

Paid designer sessions. You may purchase a scheduled one-on-one session with a designer, before or after your proof is created, to personalize or adjust your book. Sessions are booked for a set time and length. You may reschedule once, free of charge, with at least 2 hours' notice. Missing a session or cancelling with less than 2 hours' notice forfeits the session fee. Designer sessions are for adjusting your Everlasting Storybook within the available themes and formats; they do not include custom story writing, custom themes, or work unrelated to your order unless we agree otherwise in writing.

Free character session. Before you approve your character, you're entitled to one free 30-minute session with a designer per order to adjust your child's likeness. After character approval, likeness changes are handled in a $15, 30-minute designer session, as described in our Return, Refund & Remake Policy.

Rush Service. Rush Service, where offered, shortens our proof turnaround and/or production time as described at checkout. It does not shorten carrier transit time. If we miss the promised rush window, we'll refund the rush fee.

6. Your Content

What you give us. To make your book, you provide photos, names, and other details (“Your Content”). You keep ownership of Your Content.

Your promises about Your Content. You confirm that:

  • You own Your Content or have permission to use it, and you have the authority of the child's parent or legal guardian to submit the child's photos and details;
  • Your Content doesn't infringe anyone's rights, including copyright, trademark, privacy, or publicity rights;
  • Your Content isn't unlawful, obscene, hateful, or harmful, and doesn't depict anyone in a sexual or degrading way.

We may decline to produce any book containing content that we believe violates these Terms or the law, or that we find objectionable, and we'll refund your order if we do.

License to make your book. You grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, and create derivative works from Your Content as needed to create your proofs and book, provide customer support, fulfill remakes, and operate and improve our service. This includes processing your photos with AI tools and sharing them with the vendors who help us do so, as described in our Privacy Policy.

Marketing. We do not use your child's illustrated likeness or personal details in our marketing unless you have separately opted in — for example, by checking the marketing consent box at checkout. Without that opt-in, we may use only generic product imagery that does not identify your child (such as photos of the physical book with personal details obscured or replaced). The terms of the marketing opt-in are presented when you choose it and can be withdrawn for future use by contacting us.

Retention. We keep Your Content for a limited period after your order to support remakes and reorders, then delete it as described in our Privacy Policy. You can ask us to delete it sooner.

7. Our Content and Intellectual Property

Everything on the Site and in our products — story text, themes, illustrations, character art styles, layouts, designs, logos, the Everlasting Storybooks name, software, and the AI-generated illustrations of your child's character — is owned by or licensed to Print Nation, LLC and protected by copyright, trademark, and other laws.

Your purchase gives you ownership of the physical book(s) you ordered, for personal, non-commercial use. It does not transfer any rights in the underlying story, artwork, character designs, or digital files. You may not reproduce, resell, distribute, publicly display, or create derivative works from the book's content, or use our digital proofs for any purpose other than reviewing your order. Sharing a photo of your finished book on social media or with family is, of course, always welcome.

8. Using the Site

You agree not to misuse the Site — including by attempting to gain unauthorized access, interfering with its operation, scraping or copying content, uploading malicious code, or using the Site for any unlawful purpose. We may suspend or terminate your access at our discretion.

The Site may contain links to third-party websites or services. We're not responsible for their content or practices.

9. Quality Standard, Remakes, and Refunds

Our quality standard, what counts as an acceptable variation versus a genuine defect, and how remakes and refunds work are set out in our Return, Refund & Remake Policy, which is part of these Terms. In summary: full refund any time before proof approval; no cancellation or refund after approval; genuine manufacturing defects reported within 14 days of delivery are remade at no charge; and books lost or damaged in transit are remade and reshipped.

10. Shipping and Delivery

Shipping methods, production times, transit estimates, and related terms are set out in our Shipping & Delivery Policy, which is part of these Terms. Delivery dates are estimates. Risk of loss passes to the carrier when we hand off your package, but as described in our policies, we will remake and reship books lost or damaged in transit.

11. Warranties

Our commitment. We warrant that your book will be free of genuine manufacturing defects, as defined in our Return, Refund & Remake Policy, for 14 days after delivery. Your exclusive remedy under this warranty is a remake of your book as described in that policy (or, if we cannot produce a satisfactory remake, a refund). This warranty covers manufacturing defects only; it does not cover minor imperfections and acceptable variations, errors visible in a proof you approved, how closely the illustration resembles your child, color differences from your screen, or damage caused after delivery.

Implied warranties. To the fullest extent permitted by law, any implied warranties — including the implied warranties of merchantability and fitness for a particular purpose — are limited in duration to the same 14-day period. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

The Site. The Site itself is provided “as is” and “as available,” and we make no warranties about its availability, accuracy, or freedom from errors.

12. Limitation of Liability

To the fullest extent permitted by law, Print Nation, LLC and its owners, employees, contractors, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, missed occasions or events, emotional distress, or the cost of substitute products — arising from these Terms, the Site, or any product or service we provide.

Our total liability to you for any claim arising from an order will not exceed the amount you paid for that order.

Some states do not allow the limitation of certain damages, so some of these limits may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Print Nation, LLC and its owners, employees, contractors, and vendors from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Dispute Resolution

Talk to us first. If you have a problem, contact us at support@everlastingstorybooks.com. We resolve nearly every issue directly.

Informal resolution period. Before starting any formal proceeding, you agree to give us written notice describing your claim and 30 days to try to resolve it with you.

Binding arbitration. If we can't resolve a dispute informally, any claim arising out of or relating to these Terms, the Site, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Clark County, Nevada, or by video or phone if you prefer. The arbitrator may award the same relief a court could, on an individual basis. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief in court to protect intellectual property.

Class action waiver. You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim will be decided in court, not arbitration.

Opt-out. You may opt out of this arbitration agreement by emailing support@everlastingstorybooks.com with your name and order number within 30 days of your first order. Opting out does not affect any other part of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Nevada and the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to Section 14, any court proceeding will take place in Clark County, Nevada.

16. General

Changes to these Terms. We may update these Terms at any time by posting the revised version on the Site. Changes apply to orders placed after they are posted. The Terms in effect when you place an order govern that order.

Entire agreement. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Site and your orders.

Severability. If any part of these Terms is found unenforceable, the rest remains in effect.

No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

Assignment. You may not transfer your rights under these Terms. We may assign them in connection with a merger, sale, or reorganization.

Communications. By placing an order, you agree we may contact you by email, phone, or text about your order, including proof reminders. Marketing messages are governed by your consent choices and our Privacy Policy.
